Trenchhoggs Terms and Conditions

These Terms and Conditions ("Terms") govern access to and use of the Trenchhoggs website and any services offered through it. By accessing the website, requesting a quote, scheduling a service, submitting payment, or otherwise using the site, the user agrees to be bound by these Terms.

Website Use

The website may be used only for lawful purposes and in accordance with these Terms. Users agree not to use the website in any manner that could damage, disable, overburden, impair, or interfere with the website or another user's use of the website.

Prohibited conduct includes attempting unauthorized access to the website or related systems, transmitting malicious code, violating applicable law, misusing contact forms, or copying website content without permission.

Services

Trenchhoggs offers services described on the website. Service descriptions, estimates, and availability are informational unless expressly confirmed in writing, and service offerings may be modified, suspended, or discontinued at any time.

A request for service is not accepted until Trenchhoggs confirms the order, receives any required deposit or payment, or begins performance. Trenchhoggs may refuse or cancel service requests for legitimate business reasons, including scheduling conflicts, inaccurate information, unsafe site conditions, or nonpayment.

Quotes and Scope

Any quote or estimate is valid only for the period stated in the quote, or if no period is stated, for 30 days. Changes to scope, materials, site conditions, timing, or deliverables may require a revised quote and additional charges.

Work outside the original scope does not have to be performed unless both parties agree in writing. For larger or custom projects, a separate service agreement or proposal may control project-specific terms in addition to these Terms.

Scheduling and Site Access

If services require an on-site visit, the customer is responsible for providing accurate location information, safe site access, and any permissions, permits, or approvals needed for the work. Delays caused by weather, inaccessible work areas, inaccurate information, or customer unavailability may affect timing and may result in additional charges where disclosed in advance.

Missed appointments, no-shows, or inability to access the site may be treated as cancellations or rescheduling events under the applicable booking terms.

Pricing and Payment

Pricing for services is determined by Trenchhoggs and may change before an order is accepted. Once a service is accepted, payment obligations are governed by the applicable quote, invoice, checkout terms, or written service agreement.

The customer agrees to pay all service fees, applicable taxes, approved materials or pass-through costs, and any lawful collection or chargeback-related costs resulting from nonpayment or reversed payments.

If a payment is declined, reversed, or disputed, Trenchhoggs may suspend or terminate services until the payment issue is resolved.

Deposits

Trenchhoggs may require a deposit or retainer before scheduling or beginning work. Unless otherwise stated in writing, deposits may be applied to the final invoice and may be non-refundable to the extent they cover scheduling, planning, administrative work, or reserved service time.

Cancellations and Refunds

Customers must provide cancellation or rescheduling notice as soon as possible and in accordance with any service-specific booking terms shown at checkout, in a quote, or in a written service agreement. Short-notice cancellations, missed appointments, and no-shows may be subject to fees if those fees are disclosed in advance.

Unless required by law or expressly agreed in writing, completed services, custom work, planning time, travel time, reserved service time, and purchased materials are non-refundable.

If Trenchhoggs cancels a confirmed service before work begins, commercially reasonable efforts will be made to reschedule the service or refund amounts paid for services not yet performed.

Consumers may also have cancellation rights in limited situations under applicable law, including certain door-to-door or off-premises sales rules enforced by the Federal Trade Commission.

Client Responsibilities

The customer is responsible for providing complete and accurate information necessary for Trenchhoggs to perform the services. The customer also represents that they have the legal right to request the services and authorize work at the relevant property or location.

Intellectual Property

All website content, including text, graphics, logos, branding, images, layouts, and other materials, is owned by or licensed to Trenchhoggs and is protected by applicable intellectual property law. No website content may be copied, reproduced, republished, distributed, or exploited without prior written permission except as otherwise permitted by law.

Trenchhoggs retains rights in its pre-existing methods, processes, templates, documentation, and branding unless a written agreement states otherwise.

Third-Party Tools and Links

The website may include links to third-party websites, payment providers, maps, scheduling platforms, or other external tools. Trenchhoggs is not responsible for third-party content, availability, security, policies, or business practices, and use of third-party services is at the user's own risk.

Disclaimer of Warranties

The website and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Trenchhoggs disclaims warranties not expressly stated in writing, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by law, Trenchhoggs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to the website or services. Any direct liability will be limited to the amount paid for the specific services giving rise to the claim, unless otherwise required by law.

Indemnification

The user agrees to defend, indemnify, and hold harmless Trenchhoggs and its owners, employees, contractors, and affiliates from claims, liabilities, damages, losses, and expenses arising from misuse of the website, violation of these Terms, or infringement of another party's rights.

Termination

Trenchhoggs may suspend website access, decline service, or terminate a transaction if these Terms are violated, payment is not made, false information is provided, or site conditions create an unreasonable safety, legal, or operational risk.

Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles. Any dispute relating to the website or services will be brought in a court of competent jurisdiction in Minnesota unless applicable law requires otherwise.

Changes to These Terms

These Terms may be updated from time to time by posting a revised version on the website with a new effective date. Continued use of the website after updated Terms are posted constitutes acceptance of the revised Terms.

Privacy

If the website collects personal information such as names, email addresses, phone numbers, payment information, cookies, or contact form submissions, that data should also be governed by a separate Privacy Policy because privacy disclosures are distinct from terms of website use.
